Gadsden lawyer and his wife charged with felony theft from client



A Gadsden lawyer and his wife are charged with a felony crime in connection with the reported theft from a client.

John Davis McCord, 60, and Susan Rollins McCord, 59, both of Gadsden, were taken into custody on Monday, according to Rainbow City police Lt. Je’Michael R. Bonner. Susan McCord is her husband’s administrative assistant.

The investigation began earlier this month when the 47-year-old victim filed a report in reference to theft by deception. The victim told police that he was bilked out of more than $3,000.

According to the victim, Bonner said, John McCord represents the victim in a current divorce/custody case and the McCords allegedly advised the victim that he was the subject of a criminal investigation by the Etowah County District Attorney’s Office. Therefore, John McCord needed an additional retainer fee to represent the victim regarding the criminal investigation.

However, Bonner said, the victim learned from Etowah County District Attorney’s Office personnel that he was not under investigation.

As a result of the investigation, the McCords were arrested Monday on a first-degree theft by deception charged. They were booked into the Etowah County Jail and released a short time later after posting $5,000 bond. The charge is a Class B felony.

Efforts to reach the McCords for comment weren’t immediately successful.
